Our Service is designed to be privacy-focused and non-custodial, meaning we do not take custody of user funds during the swap process.

The Service currently supports swaps between the following blockchain networks: Bitcoin, Ethereum, Solana, Arbitrum, Polkadot, and others as listed on our website.

3. Eligibility

To use the Service, you must be at least 18 years old and have the legal capacity to enter into a binding agreement. By using the Service, you represent and warrant that you meet these requirements.

You accept the exchange rate provided at the time of the swap confirmation

We may decline to process or cancel a transaction if we suspect it violates these Terms or applicable laws.

7. Fees and Rates

Our Service charges fees for processing swaps. These fees include:

Service fee (2% of the transaction amount)
Network fees for the relevant blockchains

All fees are displayed before you confirm a swap. Exchange rates are determined based on current market conditions and liquidity available at the time of the swap. Rates may fluctuate between the time you receive a quote and when your transaction is executed.

8. Prohibited Activities

You may not use the Service to:

Conduct or facilitate any illegal activities, including money laundering, terrorist financing, or fraud
Violate any applicable laws, regulations, or sanctions
Infringe upon the rights of others
Disrupt, damage, or gain unauthorized access to the Service or any related systems
Attempt to bypass or manipulate our fee structure or exchange rates
Use the Service in any manner that could interfere with, disrupt, negatively affect, or inhibit other users

9. Intellectual Property Rights

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TORRENTSWAP, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED THE AMOUNT OF FEES PAID BY YOU TO TORRENTSWAP DURING THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO SUCH LIABILITY.

11. Indemnification

You agree to defend, indemnify, and hold harmless TorrentSwap and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

12. Modifications to the Service and Terms

We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. We shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

We may revise these Terms from time to time. The most current version will always be posted on our website. By continuing to access or use our Service after revisions become effective, you agree to be bound by the revised Terms.

13. Governing Law and Dispute Resolution

The seat, or legal place, of arbitration shall be as specified in our company registration.

15. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

16. Entire Agreement

These Terms constitute the entire agreement between you and TorrentSwap regarding our Service and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the Service.
